SCHEDULE 1
ALLOWANCES TO WITNESSES AND FEES FOR PSYCHIATRIC EXAMINATIONS AND REPORTS
1.0 Medico-Legal Reports

The following fees may vary depending on the complexity of the matter, the number of documents to be studied and the amount of research needed to give the medico-legal opinion:

1.1 Report for a local court matter:

1.1.1 Where an initial examination of a client is required: $1500.00

1.1.2 Where the client has previously been assessed by the clinician: $1000.00

1.2 Report for a district court matter:

1.2.1 Where an initial examination of a client is required: $2100.00

1.2.2 Where the client has previously been assessed by the clinician: $POA

1.2.3 Report for sexual offences (includes psychosexual history taking and risk assessment): $2350.00

1.3 If a client fails to attend a medico-legal appointment, or the appointment is cancelled with less than two (2) working days’ notice, half of the scheduled fee is to be paid.

1.4 Where a request for a report is cancelled, the full fee is payable if the client has attended the assessment.


2.0 Allowances to Witnesses for Expert Evidence

Where a clinician is called to give expert evidence:

2.1 Including travelling to Court, where period from departure from place of practice or other place to return thereto from attendance at Court does not exceed half a day (minimum payment): $950.00

2.2 For every hour after the first four hours: $250.00 per hour (rounded to the nearest hour)

2.3 Where teleconference facilities are made available, the amount payable shall be based on the Hourly Fee provided for in 2.2 above, charged on a scale of 10-minute increments for time spent giving evidence.

2.4 Where a clinician is required to undertake preparation for appearance as a witness including reviewing records, reports and other documentation beyond that of Police Facts Sheets, Criminal History and Medical Records not exceeding 30 pages, this time shall be paid at the hourly rate prescribed in 2.2 above.


3.0 Travelling and other allowances:

3.1 For travel to locations outside of Tamworth, payment to be made at the rate of $180.00 per hour travelled, rounded up to the nearest hour, up to two hours each way.

3.2 Exceeding two hours each way – the reasonable costs thereof plus the costs of reasonable accommodation and meals.


4.0 Cancellation Fee

Where a clinician is required to attend court and cancellation occurs, this time shall be paid as below in addition to non-refundable expenses incurred:

4.1 With less than two (2) working days’ notice of cancellation: $880.00

4.2 More than two (2) working days’ notice but less than seven (7) working days’ notice of cancellation: $440


5.0 Medical Records (Area Health Services and Private Practitioners)

5.1 Where a clinician requires medical records for the purpose of authoring a psychiatric report, then the reasonable costs charged by the service provider will be paid.

5.2 The clinician will make all reasonable attempts to obtain the medical records under the provisions of health information sharing and will make all reasonable attempts to obtain this information free of charge.

5.3 The clinician will not claim for time spent requesting medical records from Area Health Services or Private Practitioners within Australia.


6.0 Photocopying (in excess of printing three hard copies of a report)

6.1 Charges in respect of documents up to 33 pages, a minimum: $44.00

6.2 Additional charges, where more than 33 pages are provided, per page: $0.55

*** The above fees apply in respect of attendances, examinations carried out and reports ordered after 13th April 2019. These fees shall be subject to review on 1st January 2022 ***
